§483.374(b)(2) In the case of a minor, the facility must notify the resident’s parent(s)
or legal guardian(s) as soon as possible, and in no case later than 24 hours after the
serious occurrence.
Interpretive Guidelines§ 483.374(b)(2)
Review the facility policy to verify that:
a. The policy requires parental/legal guardian notification within 24 hours after a
serious occurrence; and
b. That the policy specifies who should notify the parent/legal guardian.
Review a sample of the serious occurrence reports. Verify that notification to parents or
guardians was timely, within 24 hours.
Survey procedures and probes
1. Review policy to determine:
That the policy requires parental/ legal guardian notification within 24 hours
after a serious occurrence.
That the policy specifies who should notify the parent/ legal guardian and
what information should be given.
Documentation of notification is recorded in the resident’s chart.
2. Review documentation of serious occurrences to determine if notification to parents
or guardians was timely, within 24 hours.
