Interpretive Guidelines§ 483.358(g)(1)

Each order for restraint and seclusion, an order is required regardless of the expected

length of time the restraint or seclusion will be used, the type of emergency safety

intervention used, or where the emergency safety intervention takes place. The ordering

practitioner does not need to be physically present to give the order. However, a

licensed practitioner must be available for staff consultation at least by telephone,

throughout the entire period of the emergency safety intervention, reference §483.358(d).

Documentation (resident medical record and appropriate logs) must have evidence of all

aspects of circumstances, date, time and both licensed and non-licensed staff involved in

the emergency safety intervention.

Ensure that the person writing the restraint or seclusion order is appropriately licensed

and possesses required qualifications as established by the regulation or relevant state

law.
