§483.410(a)(3) The governing body must appoint the administrator of the facility

This appointment must be in writing.
(b) Standard: Compliance with Federal, State and local laws
§483.410(b) The facility must be in compliance with all applicable provisions of Federal, State
and local laws, regulations and codes pertaining to:

The facility has no final adverse action by a Federal, State, or local authority. Such adverse
actions include, but are not limited to fines, limitation on services that may be provided, or loss
of licensure.
The facility must be able to provide for review, current licenses and permits as well as applicable
reports of inspections by State or local health authorities.
If a situation is identified indicating the provider may not be in compliance with Federal, State,
or local law, refer that information to the authority having jurisdiction (AHJ) for follow-up
actions. See W107, W108, or W109.
