BOP Program Statement 5260.01 § 8

OF ACTION

If any provision of this policy, or the application of any provision of this policy to any individual

or circumstance, is held to be invalid, the remainder of this policy and the application of its

provisions to any other individuals or circumstances shall not be affected. The intent of this

policy is for federal funds to not be expended for any medical procedure, treatment, or drug for

the purpose of conforming an inmate’s appearance to that of the opposite sex to the maximum

extent permitted by law, including the Eighth Amendment to the U.S. Constitution.

Nothing in this policy shall prevent a prison official from providing care required by federal law,

including the Eighth Amendment to the U.S. Constitution. The Bureau shall ensure that all

inmates diagnosed with GD receive care in accordance with federal law, including the Eighth

Amendment to the U.S. Constitution.

Nothing in this policy is intended, nor shall it be construed, to create a private cause of action.
