BOP Program Statement 3760.01 § 2

This program statement is under the general direction of the Health Services Division (HSD),

with the Bureau's National DFWP Coordinator (National Coordinator) administering the

program. The National Coordinator reports to the Chief, Occupational Safety & Health (OSH)

within HSD. Consistent with HHS and DOT regulations, the National Coordinator must perform

all duties specified in Chapter 6, Section A of the Model Plan for a Comprehensive Drug-Free

Workplace Program.

a. Local Responsibility. Chief Executive Officers (CEOs) must implement and administer

this program statement within their respective locations. In this program statement, CEO refers

to the following:

 Wardens

 Directors, Staff Training Centers

 Community Corrections Managers

 Regional Directors

 Assistant Directors

 Director, Federal Bureau of Prisons

b. Office of General Counsel. The Employment Law Branch, Office of General Counsel,

will provide legal counsel to management officials regarding all aspects of the program, and

provide advice and guidance to management officials concerning the following:

 Reasonable suspicion testing

 Post-accident testing

 Random testing

 Identification of specific positions as TDPs

 Disciplinary/adverse actions
