When the laboratory has confirmed a result as positive and has reported this result to the MRO,

the MRO must provide the individual providing the urine sample (donor) with the opportunity to

justify the result based on the donor's medical history. Only a licensed physician will make a

determination of illegal drug use. Such determination must be made only after the physician has

afforded the donor an opportunity to justify the positive laboratory finding. When the MRO

determines there is a legitimate reason for the presence of the identified drug, the test result must

be identified as negative.

Regardless of state or local law, MROs must not accept a prescription, or the verbal or written

recommendation of a physician for a Schedule I substance as a legitimate medical explanation

for the presence of a Schedule I drug or metabolite in federal staff or applicant specimen.
