Bonding and Insurance
An employer/union Direct Contract EGWP must meet the bonding and insurance standards
described in 42 CFR 423.504(b)(4)(iv)-(v). However, CMS may, on a case-by-case basis,
provide flexibility to an employer/union directly contracting with CMS as a Part D sponsor by
waiving these requirements upon a demonstration that different federal or state legal standards
(such as ERISA bonding requirements) are satisfied.
