Benefit Flexibility for Certain D-SNPs
Regulations at 42 CFR 422.102(e) allow D-SNPs that meet a high standard of integration (although
not necessarily as much integration as FIDE SNPs) and specified performance and quality-based
standards to offer supplemental benefits beyond those currently permitted for MA plans. CMS has
limited this benefit flexibility to qualified D-SNPs because CMS believes those plans are best
positioned to achieve the objective of keeping dual-eligible enrollees who are at risk of
institutionalization in the community.
