Enforcement Authority
42 CFR §422.156(f)
CMS retains the authority to initiate enforcement actions against any MAO that it
determines, on the basis of its own evaluation, no longer meets the Medicare
requirements for which deemed status was granted. Enforcement actions may include the
imposition of intermediate sanctions and civil money penalties (42 CFR §422 Subpart O)
or the termination or non-renewal of the MAOs contract (42 CFR §422 Subpart K).
