Premiums for Persons who are Private Pay (without Medicare or
Medicaid)

The statute does not specify the premium that may be charged to non-Medicare and non-Medicaid PACE participants. As CMS has indicated in the preamble to the final rule, it is
acceptable for a PACE organization to charge the combined Medicare and Medicaid
capitation rates as the premium for these individuals.
