Based on Sections 1894(i) and 1934(j) of the Act, CMS believes the Congress intended to
permit individuals with Medicare Part A, Medicare Part B, Medicaid, any combination of
the above, or none of the above mentioned benefits, to participate in PACE. 42 CFR §
460.150(d) states that a potential participant is not required to be Medicare enrolled or
Medicaid eligible.
A participant’s monthly premium responsibility depends upon his or her eligibility under
Medicare and Medicaid.
