Statutory and Regulatory Overview
As discussed previously, Section 1894 of the Act addresses Medicare payments to, and
coverage of benefits under, PACE. Section 1934 of the Act addresses PACE as a State
option under Medicaid for States electing PACE as an optional Medicaid benefit under
Section 1905(a)(26) of the Act. The regulations implementing these PACE statutory
requirements are set forth in 42 CFR Part 460. This manual provides further guidance on
the PACE program.
