Payments Made Upon Notice of Demand or Through An
Immediate Recoupment Request

Payments made by a provider in response to a demand are not recoupments as defined in
405.372(e). Recoupment is the recovery by Medicare of any outstanding Medicare debt
by reducing present or future Medicare payments and applying the amount withheld to
the indebtedness. Therefore, payments and recoupments from the immediate recoupment
process made in response to a demand is voluntary and are not subject to 935 interest.
