Alternative Basis for Satisfying the “Presentation” Condition
The “presentation” condition described §10.2.6 shall be deemed to be met if the guidance
was communicated generally to all providers and/or suppliers or to a class of providers or
suppliers to which the affected provider or supplier belongs rather than having been
issued in response to a specific presentation of circumstances by the provider or supplier
that is facing the imposition of the penalty.
