Disclosure of Individually Identifiable Beneficiary Information to Assignees
In accordance with the provisions of the Privacy Act, before the MAC may release beneficiary-specific
information to an assignee, the beneficiary must complete and sign a CMS-20031 naming that individual
as his/her assignee. The MAC shall use caution in releasing beneficiary-specific information to assignees.
The assignee is entitled to receive only information that an appointed representative would be entitled to
receive (e.g., the determination letter) and that which is pertinent to the case/claim for which appeal rights
have been assigned.
A beneficiary must explicitly authorize the release of any information that is not specific to the case/claim
for which appeal rights have been assigned. Any questions as to whether information needs authorization to
be released to an assignee can be directed to the appropriate CMS regional office (RO).
