Statutory Aggravating Factors (18 U.S.C. § 3592)
If you unanimously find beyond a reasonable doubt that the defendant intentionally [committed the murder(s) of] [committed acts resulting in the death(s) of] (name(s) of victim(s)) in the manner described in Instruction [(12.06)_____], you must then determine whether the [government] [prosecution] proved beyond a reasonable doubt the existence of [any of] the following alleged statutory aggravating factor(s) with respect to the [same murder(s) of] [acts resulting in the death(s) of] (name(s) of victim(s)). If you unanimously find that the [government] [prosecution] proved beyond a reasonable doubt the existence of [any of] the following alleged statutory aggravating factors with respect to the [same murder(s) of] [acts resulting in the death(s) of] (name(s) of victim(s)), you should so indicate in Section III(II) on [the appropriate] page [_____] of the Special Verdict Form and continue your deliberations. If you do not unanimously find that the [government] [prosecution] proved beyond a reasonable doubt the existence of [any of] the following alleged statutory aggravating factors with respect to the [same murder(s) of] [acts resulting in the death(s) of] (name(s) of victim(s)), you should so indicate in Section III(II) on [the appropriate] page [_____] of the Special Verdict Form, and follow the instructions at the end of the section and no further deliberations will be necessary [as to that homicide].
