DEMANDING OR OBTAINING ANYTHING OF VALUE

18 U.S.C. § 912 (SECOND CLAUSE)

Title 18, United States Code, Section 912, makes it a crime for anyone to demand [obtain]

money [paper] [documents] [something of value] while falsely assuming [pretending] to be an

officer or employee of the United States.

For you to find the defendant guilty of this crime, you must be convinced that the

government has proved each of the following beyond a reasonable doubt:

First: That the defendant falsely assumed [pretended] to be an officer [employee] acting

under the authority of the United States;

Second: That while acting in such assumed [pretended] character, the defendant demanded

[obtained] money [paper] [documents] [something of value]; and

Third: That the defendant did so knowingly, with intent to defraud.

To act “with intent to defraud” means to act with intent to wrongfully deprive another of

property.
