Alibi
(Name) has raised a defense of alibi to Count(s) (Nos.) of the indictment, and
you have heard evidence that (name) was not present at the time and place where
the offense(s) charged is (are) alleged to have been committed. The government has
the burden to prove beyond a reasonable doubt each of the elements of the
offense(s), including that (name) was present at the time and place where the offense
is alleged to have occurred. (Name) does not have to prove an alibi or that (he) (she)
was not present.
If, after considering all the evidence in this case regarding Count(s) (Nos.) of
the indictment, you have a reasonable doubt about whether (name) was present at
the time and place where the offense(s) charged was (were) committed, you must
find (name) not guilty of that (those) offense(s).
