Possession or Receipt of Firearm
Not Identified by a Serial Number
26 U.S.C. § 5861(i)
It’s a Federal crime to possess or receive a firearm that does not have a serial
number.
“Firearm” includes the kind of weapon described in the indictment.
The Defendant can be found guilty of this crime only if all the following
facts are proved beyond a reasonable doubt;
(1) the Defendant knowingly possessed the firearm described in the
indictment at the time and place charged in the indictment;
(2) the firearm did not have a serial number; and
(3) the Defendant knew that the firearm did not have a serial number.
