Possession of Firearm Having Altered
or Obliterated Serial Number
26 U.S.C. § 5861(h)
It’s a Federal crime to possess a firearm with an [altered] [obliterated] serial
number.
“Firearm” includes the kind of weapon described in the indictment.
The Defendant can be found guilty of this crime only if all the following
facts are proved beyond a reasonable doubt:
(1) the Defendant knowingly possessed the firearm described in the
indictment at the time and place charged in the indictment;
(2) the firearm’s serial number had been [obliterated] [altered]; and
(3) the Defendant knew that the serial number had been [obliterated]
[altered].
