Criminal Enterprise – Murder

21 U.S.C. § 848(e)

It’s a Federal crime to intentionally [kill] [order or otherwise cause the

intentional killing] of someone while participating in or working to further a

continuing criminal enterprise.

The Defendant can be found guilty of this crime only if you find the

Defendant guilty of engaging in a continuing criminal enterprise that existed as

charged in count _____, and all the following facts are proved beyond a reasonable

doubt:

(1) the Defendant intentionally [killed the victim] [ordered or

otherwise caused the killing of the victim] as charged in Count

_____ of the indictment;

(2) the killing occurred because of and as part of the Defendant’s

participating in or working to further the continuing criminal

enterprise charged in Count _____ of the indictment; and

(3) The Defendant intended that a killing would result.
