Burden of Proof – Clear and Convincing Evidence
Sometimes a party has the burden of proving a claim or defense by clear and
convincing evidence. This is a higher standard of proof than proof by a
preponderance of the evidence. It means the evidence must persuade you that the
claim or defense is highly probable or reasonably certain. The court will tell you
when to apply this standard.
