SIXTH CIRCUIT ADMINISTRATIVE APPEALS PROCEDURE

SDCL chapter 1-26 grants the right to judicial review of certain agency actions and

decisions. An appellant, pursuant to SDCL 1-26-31.1(1) and (2), may elect Hughes County,

located within the Sixth Judicial Circuit, as venue for the appeal.

Under SDCL 1-26-33.3(7), an appellant may make a request in their brief for the matter

to receive oral argument. Pursuant to SDCL 1-26-35, it is within the Court’s discretion to grant

the request. It shall be the duty of the Court, once its attention is called to the matter by one or

both parties, to fix a hearing, and speedily hear and determine the matter. SDCL 1-26-33.6.

(emphasis added).

An administrative appeal with venue in Hughes County will not be considered as

submitted for determination until the parties have brought the matter to the Court’s attention by

one of the following two procedures. If there is a request for oral argument, the parties must

contact the current Hughes County Civil Court court reporter and request a hearing. If the parties

are waiving the opportunity for oral argument, they must properly file a waiver with the Hughes

County Clerk of Courts with a courtesy copy emailed to the judge. The matter will not be

considered until it has been brought to the Court’s attention by one of these procedures.
