(c) At least fourteen (14) days prior to the call of the audit, counsel shall submit a courtesy

copy of a Proposed Adjudication and Final Decree to the court for consideration.

(1) Each Proposed Adjudication shall include, at a minimum:

(i) Background of the case;

(ii) Summary of distribution;

(iii) Statement of special requests or reserves requested and the reasons for

the same;

(iv) A breakdown of advanced distributions;

(v) A breakdown of balances on hand and a consolidated balance and;

(A) A summary of the proposed distribution of the consolidated

balance

(B) in the case of insolvency, a list of creditors paid and unpaid

(vi) An outline of all objections and proposed resolution.

(2) Proposed Distribution in Kind

(i) Whenever unconverted personalty or realty is included in the balance of

an account and distribution thereof in kind is proposed, a writing shall be filed

with the Petition for Adjudication/Statement of Proposed Distribution, signed

by the prospective distributee(s) and acknowledged before a person duly

authorized to take acknowledgments, setting forth the election to take in kind,

designating clearly and accurately the particular asset(s) included in the

election, stating the values at which said asset(s) shall be allotted, and

requesting the Court to order distribution accordingly; provided that the

foregoing rule shall not apply in the following instances:

(A) When the distribution is in satisfaction of a specific bequest

or devise;

(B) When the proposed distributee has, in a proper fiduciary

capacity, stated or joined in the statement of the account and

executed and verified the Petition for Adjudication/Statement of

Proposed Distribution or;

(C) When the will specifically authorizes the accountant to

make distributions in-kind.

(ii) Whenever the distribution of unconverted real estate is proposed,

whether in satisfaction of a specific devise or a request for distribution in kind,

there shall be submitted with the Petition for Adjudication/Statement of

Proposed Distribution a description by metes and bounds and Parcel

Identification Number (“PIN”) of each tract or parcel of realty to be distributed,

together with a recital of the derivation of decedent's title. Counsel for the

accountant shall certify that he has examined the last recorded deed or the

record thereof in the public office for the recording of deeds in the county in

which the real estate is located and that the description submitted is a true

and exact copy of the description contained in the recorded deed.

CHAPTER III

PETITION PRACTICE AND PLEADING
