York Cnty. C.P. Local Rules of Orphans' Court Procedure Rule 15.5
Certification of the County Agency to the Clerk of the Orphans’ Court

(e) In any adoption action initiated in the Court of Common Pleas of York County
through the filing of a petition for voluntary relinquishment to an agency, report of
intention to adopt, petition to confirm consent, petition to involuntarily terminate parental
rights, or petition to adopt involving the county agency where the underlying
dependency action has been terminated and juvenile court jurisdiction relinquished, the
county agency shall notify the clerk of the orphans’ court in the following manner within
seven days of the termination of the action:
(1) the county agency shall file a praecipe with the clerk of the orphans’
court of York County notifying the clerk that the action pending shall be discontinued
due to the termination of the underlying dependency action in the juvenile court.
(2) the praecipe shall include the caption of the dependency action and the
reason for the request to discontinue the pending action, including:
(A) the goal of adoption has been achieved in another jurisdiction,
including the name of the court where the decree was entered and the date of
the final decree of adoption, the jurisdiction of the juvenile court has been
terminated, and no further action will be taken in the orphans’ court proceeding;
(B) the goal in the underlying dependency action has been changed to
permanent legal custodianship/AAPLA. As the goal is no longer adoption, no
further action will be taken in the orphans’ court proceeding;
(C) juvenile court supervision has been terminated pursuant to
Pa.R.J.C.P. 1631 and jurisdiction relinquished. As the dependency court is no
longer supervising the child, no further action will be taken in the orphans’ court
proceeding.
(f) Upon receipt of a praecipe notifying the clerk of the orphans’ court that a final
decree of adoption has been granted in a foreign jurisdiction or that the underlying
dependency action has been terminated, the clerk may terminate the pending action
and close the case without further notice.
(g) The praecipe described above shall be substantially in the following form:

AND REQUEST TO TERMINATE PENDING ACTION
TO THE CLERK OF THE ORPHANS’ COURT OF YORK COUNTY:
Please kindly be advised that the underlying dependency action docketed to
20__ DP _____ has been terminated and jurisdiction relinquished due to:
_____ A Petition to Adopt has been granted on _[DATE OF FINAL
DECREE_ in the Orphans’ Court in ____[NAME]_______ County
concerning the above-child and docketed to __[CAPTION]________.
______The goal in the underlying dependency action has been changed
to permanent legal custodianship or AAPLA. As the goal is no longer
adoption, no further action will be taken in the Orphans’ Court proceeding.
______ Juvenile court supervision has been terminated pursuant to
Pa.R.J.C.P. 1631. As the dependency court is no longer supervising the
child, no further action will be taken in the Orphans’ Court proceeding.
