Expert Report in Lieu of Testimony
(a) If a petitioner intends to offer an expert report in lieu of deposition or live testimony,
the petitioner shall:
(1) attach a copy of the report being offered to the initial petition, and
(2) include in the petition, a statement of the intention to offer a report in lieu of
testimony which identifies the name of the physician, date of last evaluation and
specific identification of findings of the medical professional that supports the
allegations in the petition.
(d) Unless excused by Order of Court, in all cases where a party seeks to offer an
expert report in lieu of testimony, the expert completing the report shall be available to
provide live testimony at the time of the hearing for questioning by the parties and the
court.
