Petition for Adjudication

(a) (15) If guardianship of the estate is sought:

(iii) a detailed averment by petitioner outlining all efforts made to

determine the gross value of the estate, any income source and

identification of all assets belonging to the alleged incapacitated

person.

(iv) a statement whether the proposed guardian has declared

bankruptcy, and if so, the name of the court and final disposition.

(v) a statement whether the proposed guardian has been charged or

convicted of a crime, not including a traffic offense. If so, state the

charge, the court, and the final disposition.

(a) (16) If any of the writings referenced in Pennsylvania Orphans’ Court Rule

14.2(a)(6)-(a)(8) are not attached, petitioner shall include a specific averment in

the petition which outlines all efforts by anyone to locate said documents;

(b) Nomination of Guardian. In the event that a professional guardian is sought,

petitioner shall identify efforts to engage a family member or personal friend or

acquaintance of the alleged incapacitated person to serve and the reason that a

professional guardian is sought over a person familiar to the alleged

incapacitated person.

(c) Exhibits.

(3) Proposed findings of facts and proposed final decree shall be filed

contemporaneously with the petition or electronically provided to chambers

at least three (3) business days prior to the hearing;

(7) Contemporaneously with filing the petition, Petitioner shall file the

following documents with a Confidential Document Form attached. The

document shall be served on both counsel for the alleged incapacitated

person and the incapacitated person. The exhibit shall not be served,

however, on persons or institutions identified in Pa.RO.C.P 14.2(f)(2):

An affidavit or statement from an individual qualified by training and

experience in evaluating individuals with incapacities of the type alleged by

the petitioner supporting the allegations contained in the petition. Any such

statement shall indicate physical and mental capacity limitations and

recommendations for level of care required to maintain the AIP safely and

whether a limited guardian or other less restrictive alternative could be

directed to provide for the safety and well being of the AIP
