York Cnty. C.P. Local Rules of Orphans' Court Procedure Rule 10.4.1

(a) Contents of Petition. A petition appealing the decision of the Register of Wills shall

be filed with the Clerk of the Orphans’ Court and shall set forth:

(1) An outline of the proceedings before the Register of Wills;

(2) The nature of the dispute which has arisen;

(3) The names and addresses of all interested parties, including

those who have not been made parties to the record;

(4) A request for certification of the record by the Register of Wills;

(5) A request that any testimony taken before the Register of Wills

be transcribed and;

(6) A request that a citation be issued to show cause why the relief requested

should not be granted.

(b) Certification of Record.

(1) When a petition appealing the decision of the Register of Wills has been filed

with the Orphans’ Court, the Register of Wills shall certify the record to the

Orphans’ Court.

(2) When the Register of Wills certifies the record to the Court upon the

Register’s own request, any interested party may petition the Court requesting a

citation with rule to show cause issued.

(c) Service of Petition and Citation. The citation and a copy of the petition for appeal

shall be served by the moving party on all other interested parties, with a copy filed with

the Register of Wills, and a certificate of service shall then be filed pursuant to

Pa.R.O.C.P. 3.5(a)(7).

(d) Request for Disposition. After the return date of the citation has passed, and proof

of service has been filed with the Clerk of Orphans’ Court, any interested party shall file

a motion requesting the Court determine the issue in dispute. The motion shall include

any request by the parties to schedule a hearing for argument.
