Affidavit as to Military Service

(a) No judgment by default shall be filed unless the moving party shall have first filed the

affidavit required by the Servicemembers Civil Relief Act, 50 U.S.C. Appx. §521, stating whether the

adverse party is in military service as therein defined.

(b) If the moving party is unable to ascertain whether the adverse party is in military service, the

moving party shall so state in the affidavit.
