RULE NCR-308. TRANSPORTATION OF PRISIONERS
The attorney representing a defendant who is incarcerated is responsible for obtaining a
Transportation Order to secure the defendant’s appearance at trial or hearing. If a defendant is
unrepresented by counsel or is proceeding Pro Se, the District Attorney shall arrange for the
transporting of the defendant for a trial or hearing.
All Transportation Orders must be filed with the Clerk of Courts and served upon the
Sheriff of Northumberland County [three (3) certified copies] a minimum of fourteen (14)
business days (not counting the day of filing, the day of the hearing, or holidays) prior to the
scheduled date of hearing or trial when the defendant is incarcerated in an out of county
facility. The Transportation Order shall be in the same format as previously prescribed.
If the defendant is incarcerated in a facility located in the county, a Transportation
Order is not necessary but a minimum of three (3) business days’ notice to the Sheriff is
required.
