Writ of Certiorari/Appeals From Zoning Hearing Boards
(a) Form of Caption
The caption of an appeal from a decision of a zoning hearing board shall make reference
to the name of the municipality and shall be in the following form:
John Doe, Appellant,
Vs.
Zoning Hearing Board (Insert full name of municipality.)
(b) Additional Testimony
In the event that a party desires to present additional evidence, a motion indicating the
reason therefor shall be presented to the court within twenty (20) days after the filing of the
appeal, along with a rule to show cause, a comprehensive brief, and proposed order.
(c) Supersedeas
An appeal from the decision of a zoning hearing board shall not act as a supersedeas
without special order of court. An application for a supersedeas shall be in motion or petition
form, as may be appropriate, and due notice of its presentation shall be given in accordance with
these rules to the municipality or its solicitor and to the parties adversely interested in the case
who have entered an appearance.
