Lehigh Cnty. C.P. Civil Court Local Rules Rule 206.4(c)
Rule to Show Cause
(1) All petitions shall be filed with clerk of courts, and a copy thereof shall be
delivered to the court administrator’s office together with an unattached form of
order as set forth in Pa. R.C.P. 206.5. If the petition is uncontested, the petition
shall contain a certification to that effect.
(2) The assigned judge will address the petition and proposed rule to show cause. If
the petition states prima facie grounds for relief, the assigned judge shall issue a
rule to show cause and may grant a stay of proceedings. The assigned judge will
determine the return date for the rule as well as the deadlines for completion of
depositions, for an evidentiary hearing, or for argument, as the judge shall deem
appropriate.
(3) The clerk of courts shall be responsible for service of the petition and rule to show
cause on all parties.
(4) After being served with a copy of the petition and rule to show cause, the
respondent shall file an answer on or before the return date fixed in the rule.
(5) All answers to petitions shall be filed with the clerk of courts, and a copy thereof
shall be delivered to the court administrator’s office.
