Approval of Private Criminal Complaints for Summary Bad
Check Charges by Attorney for the Commonwealth
The District Attorney having filed a certification pursuant to Pa.R.Crim.P. 421 and
its Comments, summary private criminal complaints, in which the affiant is not a law
enforcement officer, as defined in Pa.R.Crim.P. 103, and which charge the crime of BAD
CHECKS, 18 Pa.C.S.A. §4105, shall not be submitted to any issuing authority unless the
private criminal complaint has been reviewed and has been approved by an attorney for
the Commonwealth.
