26THAND NOW, this day of January, 2012, this Court ORDERS as follows:

The last paragraph of this Court's Administrative Order dated the 9th day of September,

2010, related to the appointment or removal of Deputy Constables which formerly read;

"Once this Court has signed an Order approving the appointment of a Deputy

Constable, the Deputy Constable shall provide to the Office of the Administrator for

Magisterial District Judges within ten (10) days the following: a copy of the Court Order

approving the appointment of the Deputy Constable and a copy of the newly appointed

Deputy Constable's bond in the amount of $10,000.00 that has been filed in the

Delaware County Office of Judicial Support; a copy of the certificate of professional

liability insurance which has been filed in the Delaware County Office of Judicial

Support; the completed Pennsylvania State Constable Personal Information sheet; and,

a copy of the petition seeking the approval of the appointment of the Deputy Constable

with all exhibits".

Is amended to read as follows:

"Once this Court has signed an Order approving the appointment of a Deputy

Constable, the Deputy Constable shall provide to the Office of the District Court

Administrator for Magisterial District Judges within ten (10) days the following

information: a copy of the newly appointed Deputy Constable's bond in the amount of

$3,000.00 that has been filed in the Delaware County Office of Judicial Support; a copy

of the certificate of professional liability insurance showing a minimum coverage of

$250,000.00 per incident and a minimum aggregate of $500,000.00 per year which has

been filed in the Delaware County Office of Judicial Support; the completed

Pennsylvania State Constable Personal Information sheet; and, a copy of the petition

seeking the approval of the appointment of the Deputy Constable with all exhibits".

In all other respects, this Court reaffirms and republishes its Order of Court

dated the 9th day of September, 2010 related to the appointment or removal of Deputy

Constables.

AND NOW, this 1st day of March, 2011, the Order heretofore issued by

this Court on the 6ᵗʰ day of May, 2010, effective July 1, 2010, IS HEREBY AMENDED IN

TOTO and in place and stead substituted the following:

AND NOW, this 1st day of March, 2011, in accordance with the Judicial

Code, 42 Pa.C.S. $4301(b), and pursuant to the Public Access Policy of the Unified Judicial

System of Pennsylvania: Official Case Records of the Magisterial District Courts adopted by the

Pennsylvania Supreme Court effective July 1, 2010, IT IS HEREBY ORDERED that the

following procedures shall be utilized to ensure a policy is in place to govern public access to the

records of the Magisterial District Courts within the 32ⁿᵈ Judicial District.

1. Fee Schedule

Copying per page - $.25

Preparing, copying and re-filing complex or voluminous requests will be

Paid at the rate of $8.00 per ¼ hour. (The definition of complex or

voluminous requests may vary from Court to Court depending on factors

such as Court resources and caseload).

No fee shall be charged for the initial 15 minutes of staff time required to

respond to a Public Access Request.

Fees may be waived if the Court determines a requestor is indigent.

When fees are estimated at more than $100.00, then prepayment is

required.

Fees paid for services rendered are nonrefundable.

IT IS FURTHER ORDERED that seven (7) certified copies of this Order shall be filed

with the Administrative Office of the Pennsylvania Courts; that two (2) certified copies and one

(1) diskette shall be filed with the Legislative Reference Bureau for publication in the

Pennsylvania Bulletin; that one (1) certified copy shall be filed with the Civil Procedural Rules

Committee of the Supreme Court of Pennsylvania; one (1) copy to the Delaware County Legal

Journal for publication, and that one (1) copy shall be filed with the Office of Judicial Support-

Civil - - of the Court of Common Pleas of Delaware County.

The effective date of this Order shall be March 30, 2011.

elected.

Eastern Interdiction Unit involving controlled substance offenses, including but

not limited to Possession of Controlled Substance, 35 Pa.C.S. 8780-113(a)(16).

Possession with the Intent to Deliver/Delivery of Controlled Substance, 35

Pa.C.S. § 780 113(a)(30), and Possession of Drug Paraphernalia, 35 Pa.C.S.

§780-113(a)(32), as well as Criminal Conspiracy, 18 Pa. C.S.§903, to commit the

3. All cases brought by the PSP/Criminal Investigation Division Car Theft

Task Force of the Office of the District Attorney of Delaware County involving

theft of motor-propelled vehicles and fraudulent criminal activities related

thereto, including but not limited to Theft by Unlawful Taking, 18 Pa.C.S. §3921,

Theft by Receiving Stolen Property, 18 Pa.C.S. $3925, Unauthorized Use of

Automobiles and Other Vehicles, 18 Pa.C.S. $3928, and those Pennsylvania

Motor Vehicle Code Offenses set forth in the Vehicle Theft and related provisions,

75 Pa.C.S.$7101 et seq., as well as Criminal Conspiracy, 18 Pa.C.S. §903, to

commit the aforementioned offenses:

4. All Gambling cases, including but not limited to Lotteries, Pool Selling

and Bookmaking, Gambling Devices, Disorderly House, Gambling Places,

Trafficking in Lottery Tickets, Establishing and Setting Up of Gambling Place(s)

Inducing Person(s) to Gamble, and Public Nuisance(s). 18 Pa.C.S. $5512, 5513

and 5514.

5.All offenses and cases of Extortion and related Theft brought by the

Office of the Attorney General of Pennsylvania against Commonwealth

employees of the Bureau of Standard Weights and Measures, 18 Pa. C.S. §3901

et seq.

Included in the above venue and jurisdiction shall be all offenses arising

out of the factual circumstances included in the above designed offenses.

This order shall become effective May 1, 2005. All matters then pending

before District Justice Peter Tozer, Magisterial District 32-2-42, pursuant to this

Court's past Order regarding the matters described herein, shall then be

immediately transferred to District Justice Nicholas S. Lippincott, Magisterial-

District 32-2-46, for any and all proceedings as then required by the

Pennsylvania Rules of Criminal Procedure.

It is further ORDERED and DECREED that all previous Court Orders

designating venue and jurisdiction in these certain classes of offenses are hereby

revoked as of 2005, the effective date of this Order.
