IN RE: TEMPORARY ASSIGNMENT OF

ISSUING AUTHORITY

AND NOW, this 1st day of June, 2015 pursuant to Rules 17 and 112 of the Rules

Governing Standards of Conduct of Magisterial District Judges, and Rules 130, 131, 132

and 133 of the Rules of Criminal Procedure, promulgated by the Supreme Court of

Pennsylvania, the following temporary assignment to act as Alternate Issuing Authority in

other Delaware County Magisterial Districts whenever required for the efficient

administration of justice to is hereby established and shall apply to and effect all magisterial

districts as set forth herein:

Magisterial District 32-2-46 may act as Alternate Issuing Authority in Magisterial

Districts 32-1-20, 32-1-21, 32-1-22, 32-1-23, 32-1-24, 32-1-25, 32-1-26, 32-1-27, 32-1-28,

32-1-30, 32-1-31, 32-1-32, 32-1-33, 32-1-34, 32-1-35, 32-1-36, 32-2-37, 32-2-38, 32-2-39,

32-2-40, 32-2-41, 32-2-42, 32-2-43, 32-2-44, 32-2-47, 32-2-48, 32-2-49, 32-2-51, 32-2-52,

32-2-53, and 32-2-54, under the following circumstances:

1.)Magisterial District 32-2-46 shall address any and all outstanding Delaware

County Summary Warrants for persons otherwise lawfully detained by the Upper

Providence Police Department between 8:30 am and 4:30 pm on Tuesdays and

Thursdays that the said Court is in session.

2.)Magisterial District 32-2-46 shall have the authority in cases described in

Paragraph (1) to cancel Warrants, schedule hearings for unresolved matters in

other jurisdictions, accept pleas, set and accept payments and collateral, conduct

payment determination and inability to pay hearings and otherwise dispose of and

address matters related to outstanding Delaware County Summary Warrants.

This Order shall remain in effect until Rescinded by Order of this Court.

32-1-25 to Hear Certain Classes

Of Offenses

AND NOW, to wit, this 13th day of May, 2015, it is ORDERED and DECREED as

follows:

WHEREAS, Delaware County has, pursuant to Laws of the Commonwealth of

Pennsylvania, formed a County Weights and Measures Department, and;

WHEREAS, the County Weights and Measures Department may prosecute for

violations of the Weights and Measures Act of 1996, Act 155 of 1996, 3Pa.C.S. Ann. §

4101 et seq., and Ordinance No. 99-6 of the County of Delaware, or any other Law,

Statute, or Regulation of the Commonwealth of Pennsylvania which authorizes

supervision and prosecution by the Delaware County Weights and Measures

Department and;

WHEREAS, the interest of Justice and an efficient handling of all matters

prosecuted by the Delaware County Weights and Measures Department requires that a

Magisterial District Judge in the County of Delaware be designated as the Magisterial

District where offenses commenced by the Delaware County Weights and Measures

Department may be commenced and prosecuted to a final conclusion;

NOW THEREFORE, pursuant to the Authority contained in Pennsylvania Rules

of Criminal Procedure, Rule 21 (d) and Rule 23 and 24, It is ORDERED and DECREED

that District Court 32-1-25, Magisterial District Judge Robert R. Burke, Esquire shall

have County wide jurisdiction for the handling of all matters commenced by the

Delaware County Weights and Measures Department.
