IMPOSSIBILITY
IMPOSSIBILITY
A party is relieved from the duty to perform a contract if:
1. It has become impossible to perfor m because of an occurrence that was
beyond the control of the parties; and
2. Neither of the parties could reasonably foresee the occurrence when they
made the contract.
