UNDUE INFLUENCE
UNDUE INFLUENCE
A party need not perform a contract which was entered into as a direct result of
undue influence. Undue influence involves:
1. The misuse of a confidential relationship [or a pos ition of authority] to take an
unfair advantage over another person; or
2. Taking an unfair advantage of another person's weakness of mind; or
3. Taking a grossly oppressive and unfair advantage of another person's
misfortune [or circumstances].
