EXCUSE OF CONDITION

Even though a contract may call for a cond ition to be satisfied before a party's

performance is required, in some cases the condition may be excused so that the party's

performance is required even though the condition has not been satisfied. In this case,

[Plaintiff] claims that the condition in the contract that [state the terms of the condition

that is in issue] was excused because [state the basis of the excuse].
