CONSTRUCTIVE DISCHARGE

An employer is considered to have disc harged an employee if the employer either

knew or should have known that the employee' s working conditions were so intolerable

that a reasonable person in the employee's situation would feel that [he/she] had no

choice but to quit. You should consider wh ether the employer physically threatened or

humiliated the employee, how often the em ployer did so, and whether the employer

unreasonably interfered with the employee’s work performance.
