EMPLOYMENT BASED DISCRIMINATION – RETALIATION
[Plaintiff] claims that [Defendant] discriminated against [him/her] because of
[his/her] [set out the protected activity relatin g to discrimination that Plaintiff
engaged in] by [specify adverse employment action such as terminating his/her
employment, or failing to hire or promote him/her] . In order to prevail on the claim
of retaliation, [Plaintiff] must show by the weight of the evidence that:
1. [Plaintiff] is [set out the protected activity that Plaintiff engaged in].
2. [Defendant] retaliated against [him/her] because of [his/her] [set out the
protected activity] by [specify adverse employment action]; and
3. [Plaintiff] was damaged as a result of the retaliation.
