NONDISCLOSURE OR CONCEALMENT --- ELEMENTS OF LIABILITY
NONDISCLOSURE OR CONCEALMENT --- ELEMENTS OF LIABILITY
In order for [Plaintiff] to recover from [Defendant] on [his/her] claim of deceit,
you must find that all of the following have been established by clear and convincing
evidence:
1. That [Defendant] concealed or failed to disclose a past or present fact which he
had a duty to disclose;
2. That the fact was material;
3. That [Defendant] concealed or failed to disclose it with the intent of creating a
false impression of the actual facts in the mind of [Plaintiff];
4. That [Defendant] concealed or failed to disclose it with the intention that it
should be acted upon by [Plaintiff];
5. That [Plaintiff] acted in reliance upon it; and
6. That [Plaintiff] thereby suffered injury.
