MALICIOUS PROSECUTION --- CIVIL ACTION --- ELEMENTS OF LIABILITY

In order for [Plaintiff] to recover from [Defendant] on [his/her] claim, you must

find that all of the following have been established:

1. The bringing of the original action by [Defendant] against [Plaintiff];

OUJI 3d (Rev. 2009) Chapter 16

2. The successful termination of the original action in [Plaintiff's] favor;

3. The want of probable cause to join [Plaintiff] in the original action;

4. That the bringing of the original action was malicious; and

5. That as a result of the bringing of the original action [Plaintiff] sustained injury.
