ACTUAL DAMAGES --- MALICIOUS PROSECUTION
ACTUAL DAMAGES --- MALICIOUS PROSECUTION
If you find in favor of [Plaintiff], you shall assess as [his/her] actual damages an
amount that will fairly and justly compensate [him/her] for the malicious prosecution.
In determining such damages you shall take into consideration [Plaintiff's] actual
injuries, including the harm, if any, to [his /her] reputation and mental or emotional
distress that directly resulted from the malicious prosecution.
In addition, you may consider court costs, reasonable attorney's fees and any other
reasonable expenses [Plaintiff] incurred in defending [himself/herself] in the
[criminal/civil] action instituted against [him/her], and a reasonable sum for the time
[Plaintiff] spent in defending [himself/herself] in the [criminal/civil] action instituted

against [him/her], and a reasonable sum fo r the time [Plaintiff] necessarily lost in
preparing for and in attending the trial of the [criminal/civil] case, loss of income,
damage to [his/her] business and [insert here any other items of special damage of which
there is evidence] which directly resulted from the malicious prosecution.
