AFFIRMATIVE DEFENSE --- ADVICE OF PROSECUTING ATTORNEY
If the prosecuting attorney, after [Def endant] made a full, honest, and fair
disclosure of all the facts which [he/sh e] knew or ought reasonably to have known
bearing upon the alleged guilt of [Plaintiff] de termined that such facts constituted an
offense and commenced the criminal action against [Plaintiff], [Defendant] is not liable.
