LANDLORD’S DUTY TO TENANT – IN GENERAL

A lessor/landlord has a duty of care to a lessee/ten ant to maintain the leased

premises, including areas under the exclusive contr ol or use of the lessee/tenant, in a

reasonably safe condition. A lessor/landlord is required to act reasonably when the

lessor/landlord knows or reasonably should know of a defective condition and has a

reasonable opportunity to make repairs.
