DUTY OF PASSENGER

A passenger has the duty to use ordinary care for [his/her] own safety. When,

considering all circumstances, the exercise of ordinary care requires that the passenger

either caution the driver against the manner of the vehicle's operation or warn the driver

of a dangerous condition, [he/she] has a duty to do so.
