Ohio Appt.Coun.R. 1.04
Applicability
The Rules for Appointment of Counsel in Capital Cases shall apply in either of the following
cases:
(A) An indigent defendant has been charged with aggravated murder and the
indictment includes one or more specifications of aggravating circumstances listed in
R.C. 2929.04(A);
(B) An indigent juvenile defendant has been charged with aggravated murder and the
indictment includes one or more specifications of aggravating circumstances listed in
R.C. 2929.04(A), even though the defendant is under eighteen years of age and cannot be
sentenced to death.
