Application for writ, order to another judge prohibited when same application pending before different judge or previously denied; exception

When an application or petition for any writ or order shall have been made to a justice of the peace and is pending or has been denied by such justice, the same application or motion shall not again be made to the same or another justice of the peace, except upon the consent in writing of the justice to whom the application or motion was first made.
