Waiver of personal appearance and notice to the prosecution that defendant chooses not to attend the preliminary hearing
Except as otherwise provided by statute or court rule, the waiver must be in the following form:
WAIVER OF PERSONAL APPEARANCE
Comes now the above-captioned Defendant and signatory below to let it be known that having been apprised of my right to be present, confront and cross-examine witnesses, view all evidence, present evidence, and call witnesses on my behalf, I elect, after consultation with my attorney, to waive my personal appearance at the scheduled preliminary hearing.
Furthermore, I understand the prosecution could subpoena me for the hearing and that should a witness testifying at the preliminary hearing later become unavailable should the matter be bound over for trial, the prosecution could successfully have admitted at that trial the transcribed preliminary hearing testimony over my objection that it should not be admitted due to my absence and not personally having had the opportunity to cross-examine the witness.
