ORDER 8
WHEREAS, this matter came on for consideration upon recommendation of 9
the Administrative Office of the Courts (AOC) to adopt the Witness Fee Fund 10
Payment Guidelines to facilitate the administration of the “jury and witness fee fund” 11
created under NMSA 1978, Section 34-9-11 (2017); 12
WHEREAS, the guidelines are intended to act as universal guidelines for 13
cases in New Mexico state courts involving witnesses called by s tate agencies, 14
define responsibility for payment of witness costs, and rovide direction for 15
controlling witness costs; and 16
WHEREAS, the Court having considered the recommendation and being 17
sufficiently advised, Chief Justice David K. Thomson, Justice Michael E. Vigil, 18
Justice C. Shannon Bacon, Justice Julie J. Vargas, and Justice Briana H. Zamora 19
concurring; 20
NOW, THEREFORE, IT IS ORDERED that Witness Fee Fund Payment 1
Guidelines are ADOPTED. 2
IT IS SO ORDERED. 3
WITNESS, the Honorable David K. Thomson, Chief 4
Justice of the Supreme Court of the State of New Mexico, 5
and the seal of said Court this 15th day of October, 2024. 6
